Real Estate

The firm maintains a diverse real estate practice that represents clients in all aspects of real estate law, including development, land use and permitting, leasing, project finance, condominium conversions, acquisitions and dispositions.  We have represented clients in nearly every type of large and small-scale commercial project, including shopping centers and malls, office buildings, and mixed-use urban centers, as well as residential developments and industrial facilities.

Real estate development
In real estate development transactions, our attorneys draft and negotiate purchase and sale agreements and other contracts, prepare zoning studies, coordinate environmental studies, review and analyze local and state permits and permitting requirements and negotiate with state and federal agencies and community groups.  They have converted a wide range of buildings into condominiums, including two-tiered condominiums.  They also review titles and analyze existing leases, as well as provide assistance in structuring acquisition financing, negotiation of financing terms, and analysis of the tax implications of proposed transactions.

Real estate financing
Posternak real estate attorneys also handle project financings, representing all types of borrowers and lenders, including domestic and foreign corporations, limited liability companies, limited partnerships, local banks, large national banks and other institutional lenders.  They have extensive experience with synthetic leasing, sale-leaseback transactions and securitized loans.

Leasing
A large portion of the firm’s real estate practice focuses on leasing, especially in the retail industry.  Clients include landlords, investors, lenders and tenants in leases for all types of projects, including regional malls, community shopping centers, stand-alone department stores, factory outlets, office buildings, restaurants and retail boutiques.
